Welcome to DIG//SUSTER.
These Terms & Conditions apply to your use of this website and to any order placed with DIG//SUSTER.
By using this website or placing an order, you agree to these Terms & Conditions.
Nothing in these Terms & Conditions is intended to remove or limit any rights you may have under applicable South African consumer law.
1. ABOUT DIG//SUSTER
DIG//SUSTER sells branded merchandise, including clothing and related products.
Many of our merchandise items are prepared and printed specifically according to each customer’s order.

2. PLACING AN ORDER
Customers are responsible for checking all information entered when placing an order.
Before submitting your order, please make sure that you have selected the correct:

A size chart is provided on the website to assist customers in choosing the correct garment size.
Once an order has entered production, changes may no longer be possible.
3. ORDER CONFIRMATION
Submitting an order form does not necessarily mean that your order has immediately entered production.
Once your order has been received, you will receive an order confirmation containing your order details, payment information and unique order number.
Please check your order confirmation carefully.
If any information is incorrect, contact digsuster@gmail.com as soon as possible.
4. PAYMENT
Payment must be made using the payment instructions provided with your order confirmation or invoice.
Where payment is made via EFT, customers must use their Order Number as the payment reference.
Your order will only be placed into production once payment has been received and confirmed.
We may request Proof of Payment where necessary.
Proof of Payment can be sent by replying to the relevant order email or, if necessary, directly to:
5. PRICING
All prices displayed on the website are shown in South African Rand unless otherwise stated.
We make reasonable efforts to ensure that prices and product information are accurate.
If an obvious pricing or technical error occurs, DIG//SUSTER reserves the right to correct the error before accepting or fulfilling the affected order.
If payment has already been made and we are unable to fulfil the order because of such an error, we will contact the customer and arrange an appropriate solution.
Consumer-facing pricing and marketing may not be misleading under the Consumer Protection Act.
6. MADE-TO-ORDER MERCHANDISE
DIG//SUSTER merchandise is generally printed specifically according to the products, sizes and quantities selected by the customer.
Because items are specially prepared for individual orders, customers should carefully check their selections before making payment.
Please refer to our Returns & Exchanges Policy for full information regarding returns, incorrect sizing and defective products.
7. SIZING
Customers are responsible for selecting the correct size when placing an order.
A size chart is available on the website for this purpose.
We do not accept returns or exchanges simply because a customer selected the incorrect size, where the correct product and size ordered were supplied.
This does not affect a customer's rights where DIG//SUSTER supplied the wrong size, a defective product or goods that do not comply with applicable consumer law.
8. RETURNS, REFUNDS & EXCHANGES
Our Returns & Exchanges Policy forms part of these Terms & Conditions.
Because merchandise is printed specifically for each order, we do not generally accept returns, exchanges or refunds for:

Change of mind

Incorrect size selected by the customer

Incorrect product or colour selected by the customer

A customer deciding that they no longer want the product
Defective, damaged, incorrectly printed or incorrectly supplied products will be handled in accordance with our Returns & Exchanges Policy and applicable South African law.
The Consumer Protection Act protects consumers against unfair terms and provides rights relating to product quality and remedies in appropriate circumstances.
9. PRODUCTION TIMES
Orders generally require approximately 7 working days to be printed and prepared once payment has been confirmed.
This is an estimated production period and does not include courier delivery time.
Production may occasionally take longer due to circumstances such as:

High order volumes

Supplier delays

Stock availability

Printing delays

Public holidays
-
Circumstances outside our reasonable control
Where a significant delay affects an order, we will make reasonable efforts to communicate this to the customer.
10. SHIPPING & DELIVERY
Our Shipping Policy forms part of these Terms & Conditions.
Customers are responsible for providing complete and accurate delivery information.
Courier delivery times are estimates and may vary depending on the destination and courier service.
DIG//SUSTER cannot guarantee an exact courier delivery date once a parcel has been handed over to the courier.
If incorrect delivery details supplied by the customer result in additional courier charges, the customer may be responsible for those additional costs.
11. PRODUCT IMAGES & COLOURS
We make reasonable efforts to display our merchandise accurately.
However, colours may appear slightly different depending on:

Photography

Printing processes
Small differences between a digital representation and a physical printed product do not automatically mean that the product is defective.
12. PRODUCT AVAILABILITY
Products and sizes are subject to availability.
Although an item may appear on the website, stock availability can sometimes change before an order enters production.
If a product becomes unavailable after you have placed an order, we will contact you to discuss an alternative, replacement or refund where appropriate.
13. WEBSITE INFORMATION
We try to keep all information on this website accurate and up to date.
However, occasional errors may occur in product descriptions, prices, images or other website content.
We reserve the right to correct genuine errors where necessary, provided that this is done in a manner consistent with applicable consumer law.
14. INTELLECTUAL PROPERTY
Unless otherwise stated, the DIG//SUSTER name, branding, logos, designs, artwork, photographs, graphics and other original website content belong to DIG//SUSTER or are used with permission.
You may not copy, reproduce, sell, commercially exploit or use our branding or designs without permission.
Purchasing an item containing DIG//SUSTER artwork does not transfer ownership of the underlying artwork or intellectual property to the customer.
15. UNAUTHORISED USE
You may not use this website:

16. LIABILITY
DIG//SUSTER will take reasonable care in processing orders and supplying merchandise.
However, to the extent permitted by law, we are not responsible for indirect losses resulting from circumstances outside our reasonable control.
Nothing in these Terms & Conditions excludes liability or consumer rights where such exclusion is prohibited by South African law.
South African consumer law specifically prohibits unfair or unreasonable contract terms and suppliers cannot simply contract out of statutory consumer protections.
17. THIRD-PARTY SERVICES
We may use third-party services such as:

These third parties may have their own terms, policies or service limitations.
DIG//SUSTER is not responsible for third-party systems that are completely outside our reasonable control, but we will assist customers with order-related issues where reasonably possible.
18. PERSONAL INFORMATION
Personal information supplied when placing an order will be used for purposes reasonably connected with processing and fulfilling the order, including communication, payment administration and delivery.
You should also have a separate Privacy Policy on your website explaining how personal information is collected, stored and used.
19. CHANGES TO THESE TERMS
DIG//SUSTER may update these Terms & Conditions from time to time.
Any updated version will be published on this website with a revised “Last updated” date.
Changes will not unfairly remove rights that have already arisen under an existing order.
20. GOVERNING LAW
These Terms & Conditions are governed by the laws of the Republic of South Africa.
Nothing in these Terms & Conditions limits any rights or remedies available to consumers under applicable South African law.
The Consumer Protection Act establishes national consumer-protection standards, while the Electronic Communications and Transactions Act regulates electronic transactions and certain obligations of online suppliers.
